Prop 28, or Arts and Music in Schools Funding, is a California state referendum that increases annual funding for arts and music education programs in California TK-12 schools.

Yes. Funds must be used to expand arts and music education, including hiring teachers, purchasing curriculum and materials, and supporting professional development.
LEAs with 500 or more students are required to use at least 80% of their funding to hire certificated arts educators– LEAs with less than 500 students are not subject to this requirement. Any non-personnel funds may be used for “training, supplies and materials, and arts educational partnership programs.” No more than 1% of funds may be used for administrative expenses.
Regardless of enrollment numbers, Prop 28 funds must supplement, not supplant existing arts education budgets, meaning they must enhance or expand arts programs rather than replacing current funding sources. For example, LEAs cannot use Prop 28 funds for existing arts educators’ salaries but can use them to hire new arts educators.

Prop 28 funds can be rolled over for up to three years. At the end of the third fiscal year, any unspent funds must be returned to the state.

“Arts education program” includes (but is not limited to) instruction and training, supplies, materials, and arts educational partnership programs for instruction in dance, media arts, music, theatre, and visual arts including folk art, painting, sculpture, photography, craft arts, creative expression including graphic arts and design, computer coding, animation, music composition, ensembles, script writing, costume design, film, and video.
